Historic Fly Fishing “Cabin” Gets off Hook of Trolling Family Member

An opportunistic family member prepared and recorded a phony deed which purported to convey title to a valuable, historic Fly Fishing Cabin in the mountains to herself; all to the detriment of the true beneficiaries.  The firm’s client, a Trust, challenged the conveyance, asserting that it was the rightful owner of the Cabin, and that the phony conveyance cheated other members of the family.  After trial, the El Paso County District Court entered judgment in favor of the Trust. The Court found that the family member’s deed was void, and of no effect, and that her actions were entirely improper. The Court further ordered the defendant to vacate the Cabin and return it to the Trust.   The firm’s client was represented by Murray Weiner and Sara Frear.
