Mr. Berg practices exclusively in the areas of construction law and litigation.  His clients include public and private owners, contractors, subcontractors, suppliers, architects, engineers and home builders.  Mr. Berg is experienced in reviewing, negotiating and preparing construction contracts and related agreements and in litigating and arbitrating disputes that arise in connection with them, including claims based on delay, lost labor productivity, non-payment, and changes, and claims against performance and payment bonds.

A 1986 graduate of the University of Michigan, Mr. Berg received his law degree magna cum laude from Thomas M. Cooley Law School, where he was an Editor of the Law Review.  Mr. Berg has authored a number of articles regarding construction law matters.  He is Colorado’s contributing author of The State-by-State Guide to Architect, Engineer, and Contractor Licensing (S. Walker, R. Holderness & S. Butler 2d ed. 2013), and one of the contributing authors of The State-by-State Analysis of Legal Issues Affecting Architects, Engineers, Contractors and Owners (M. Dodd 2d ed. 2013).  He has also authored chapters about licensing and construction disputes for The Practitioner’s Guide to Colorado Construction Law (R. Benson, J. Bridston and T. Gordon 3d ed. 2020).

Mr. Berg is a member of the Board of Directors of the Colorado Springs Housing & Building Association and a member of the Board of Directors of the Colorado Association of Home Builders.  He is the Treasurer of Family of Christ Lutheran Church in Monument. 

In 2003, Mr. Berg was honored by the Colorado Springs Business Journal as one of Forty Achievers Under 40.  He has been honored as a top construction lawyer by Colorado Springs Style magazine every year construction law has been identified as a specialty, and he is a 2019-2023 Super Lawyer and is a 2019-2023 Best Lawyers© in Construction Law. 

Mr. Berg is a Fellow of the Construction Lawyers Society of America, an invitation-only national organization of top construction attorneys.  He is a member of the American Bar Association, the Colorado Bar Association, the El Paso County Bar Association, and the Trial Law Institute.
